What is Express Probate?
You don’t often hear “Express” and “Probate” in the same sentence. It’s an oxymoron.
Yet, that is exactly what Lutz Attorneys seeks to achieve in the administration of Probate Estates.
When an Estate is filed in the Probate Court, the Court sets a time line for completion of all the tasks that fall under the umbrella of “Estate Administration.”
Those steps include:
1. Open the Estate by filing the initial documents with the Court. These documents:A. Identify the people who have an interest in the Estate, and;B. Present the Last Will and Testament, if there is one.
2. File an Inventory and Appraisal, telling the Court and the Beneficiaries what assets are to be administered in the Estate.
3. Liquidate the assets, pay the bills, distribute the remainder to the Beneficiaries, either under authority of the Will or the Court.
4. Account to the Court for what assets came into the Estate and where they went.
